Richard Hollingworth Wins Dismissal Of An Injured Employee Accused of Theft To Have Workers' Compensation Benefits Reinstated

Richard Hollingworth, a member of Goldfein and Joseph, recently won dismissal of a reinstatement petition filed by an injured employee of a manufacturing plant on theft charges. Claimant, a 40 year-old factory worker, sustained a work-related back injury in 2006. When he returned to light duty work a year later, he was shortly thereafter terminated from employment on theft charges. He filed a Petition to Reinstate his total disability benefits, denying the theft and alleging a "conspiracy" to terminate him so his benefits could be denied. Following numerous hearings and testimony of multiple witnesses, the judge dismissed the claimant’s petition, concluding that the claimant stole the property and was therefore justifiably discharged, and was not entitled to a reinstatement of wage loss benefits.
