Joseph Moyer Successfully Defended Workers' Compensation Claim Following Which PA Charged Claimant With Fraud

Joseph Moyer successfully defended a workers' compensation claim on behalf of a temporary employment business.

Two weeks before the alleged accident, the male claimant, through placement by the defendant staffing business, began working as a temporary laborer at a piping manufacturer's facility, lifting 150-pound panels with a co-worker. The claimant alleged that, on a Friday afternoon in August sof 2005, he sustained an injury to the anterior cruciate ligament of his left knee though he did not realize how serious the injury was until that evening when it began to throb and swell.

Our investigation on behalf of the employer disclosed that the accident was not work-related but that it actually occurred the following day on a Saturday during a volleyball game. Furthermore, based on the severity of the alleged injury, the claimant would, in all likelihood, have suffered immediate swelling and pain necessitating medical treatment sooner than the day or two later when he was actually treated.

After extended claim litigation, the workers' compensation judge rendered a decision denying the claim petition. Following that decision, the Commonwealth of Pennsylvania filed criminal charges against the claimant for workers' compensation fraud and criminal intent to commit fraud by deception. At his arraignment, in May 2009, the defendant plead not guilty and awaits trial.
