Bernard Levinthal Wins Defense Verdict in First MDL before Judge Robreno
In the first Multi District Litigation asbestos case to be tried before the Honorable Eduardo Robreno, Bernard Levinthal recently obtained a defense verdict on behalf of a manufacturer of vinyl asbestos tiles.
The plaintiff claimed he suffered mesothelioma as a result of his employment with a flooring company in high school when he worked as a laborer and installer of vinyl asbestos flooring. Additionally, the allegations included exposure to other types of asbestos products while he was aboard ship for a year and a half while in the army.
Mr. Levinthal argued that the mesothelioma was not caused by exposure to the defendant's products and questioned whether the plaintiff actually worked for the floor tile company.
After a two-week trial, the jury returned a defense verdict.
