Michael Ksiazek Wins Summary Judgment in Philadelphia Common Pleas Court

Michael C. Ksiazek recently won summary judgment in the Philadelphia Court of Common Pleas on behalf of his client, a Philadelphia University, and other defendants in a case of construction/premises liability.

The plaintiff, a 51 year old electrical contractor, allegedly sustained injuries to his back while sweeping water from the flooded floor of defendant's property where he was working on a renovation of one of the university's buildings. Allegedly these injuries preclude him from ever working again.

In moving for summary judgment, Mr. Ksiazek argued that the university did not owe a duty to the plaintiff because the plaintiff's involvement with the flood was not foreseeable to the owner of the property and, furthermore, the plaintiff's voluntary actions were a superseding cause of his injuries.

The Honorable Frederica A. Massiah-Jackson granted summary judgment in favor of the university and the other defendants. The plaintiff has filed an appeal.
