G&J Successfully Defends Harrisburg Restaurant Against Workers' Compensation Claim

Brian Carter, an associate with Goldfein and Joseph, successfully defended a Harrisburg restaurant in a Workers’ Compensation Claim Petition despite the restaurant’s late Answer. The claimant, a 46 year-old female who worked for the company for several months, alleged a low back injury when she lifted a keg of beer. The restaurant, uninsured at the time of the alleged injury, retained Goldfein and Joseph three months after litigation commenced. In dismissing the Claim and Penalty Petitions, the workers’ compensation judge held that, despite the late Answer, the employee failed to prove all of the elements of her claim. In addition, the judge held that the only possible conclusion to be drawn from the employee’s medical evidence was that she did not suffer any work injury during her employment at the restaurant.
